if congress passes a law for all americans why wouldn't that apply to congress, too? tonight, senator rand paul's lonely fight to make it a reality. breaking tonight, fox news has confirmed that while the the president was promising you could keep your health care plan the white house has known for almost three years if not more that the promise wouldn't hold for millions of americans. we have evidence. good evening, everyone. i'm megyn kelly. americans heard this president say it over and over. if you like your doctor, you like your plan, you can keep them under obama care. many had doubts. one major concern that those buying insurance on the individual market, people without employer coverage would see their plans cancelled. why? those plans tend to be cheap with less benefits. obama care requires insurers to beep up coverage. that costs money. the fear was that insurers forced to offer more benefits would raise rates or dump policies all together.

that's exactly what is happening. contrary to the president's explicit promises. listen. >> actually, any insurance you currently have would be grandfathered in so you could keep. so you could decide not to get in the exchange the better plan. i could keep my acme i insurance, just a high deductible catastrophic plan. i would not be required to get the better one. >> but that's not what's happening at all. exactly what he said would not happen is happening. you are required to get rid of the acme plan. you are required to buy one on the, change and it is costing americans more. so far nearly a million policies have been cancelled. over ten million more could end soon. 14 million. with the american people now demanding answers you can keep your plan, period, today turned into maybe for most. for the majority.

well, some can. et cetera, et cetera, et cetera. here is former white house senior adviser david axelrod earlier and follow up from ed henry. >> most people will keep their own plans and you know it. the majority of people in this country, the vast majority of people in this country are keeping their plans. >> this morning david axelrod was pressed on the point and said the majority, the vast majority will get to keep their plans. he no longer works at that time white house. from the podium will you admit when the president said if you have a plan you will get to keep it and that was not true uh. >> well, let's be clear. the wha everybody said all along is there are going to be changes brought about that create minimum standards of coverage. >> right. then he also said if you like your plan you could keep it, period. we have dug up an irs form tonight from 2010 that shows this the administration knew that 10 million americans would not keep their plan, could not

keep their doctor. yet the president went out as recently as 2012 and said if you like your plan you can keep it. meantime there is a regulation -- an irs regulation pushed by hhs, human services, that said estimated tens of millions would be dumped. mark thiesen from the american enterprise institute and speech writer for president george w. bush. this is it. it is one thing to say -- he said they were going to get to keep their plans, period. now this regulation shows that months after obama care was passed, july, it passed in march. july or before, i should say. they knew. they were estimating internally in the administration ten million people will lose insurance. >> you've got the smoking gun in your hand. they knew. when president obama looked the american people in the eye and said if you like your health insurance, you can keep your current plan, period, no matter what, that was a bald-faced lie.

he intended -- in fact, i think they intended for these people to lose their health insurance. the reason for that is -- as you pointed out -- it will be up to 14 million people. why do they want them to lose insurance? they need them to move into the exchanges to subsidize poor people. the individual mandate is the most lucrative part -- excuse me, the individual market is the most lucrative segment of the health insurance industry because they don't use a lot of services and they are generally healthy. those are people they need to move into the exchanges in order to subsidize obama care. while president obama was going out there saying you won't lose your health insurance, period, all along they were planning for those people to lose their health insurance -- 14 million of them -- and move into the exchanges. >> as we watch the website fall apart, he dwunt have to worry. though the young people aren't signing up now because the website is a mess, he knows that they are being cancelled. that millions of americans will

have no choice but to sit on that website for days on end eventually because he knows, as we all know now, that millions of americans are going to get cancelled. >> there's the uh rub. they didn't anticipate the failure of the website. if you are one of the 14 million or so people who are losing current health insurance you're stuck with two options. one is to pay these new premiums you can't afford because they are raising your insurance rates between 99% and 400%, or go into the exchanges except because the website doesn't work you can't get into the exchanges. what's going to happen is the unintended consequence is they are pushing millions of people out of health care they like into obama care except people can't get into obama care. so on january 1, you're going to have potentially millions of people who once had health care and no longer have it because of obama care. >> in that sound bite you have

senator jon kyl asking the president what about the individual insurance market. what about people who have plans there. you are raising the requirements. that will cost more people cancelled. you heard the president specifically say it's not true. you can keep your acme plan if you like it. that is not true. mark, thank you. >> thank you. >> we have much more including this. in a "the kelly file" exclusive we sat down with a group of people from a growing group of americans losing their plans and doctors. we don't the know all of the reasons yet. we know the patients and figs believe it is due to obama care and they are not happy. >> i don't are want to change my doctor or go to another office. i'm happy. >> we got a letter in the mail. a cold letter. >> you get a letter in the mail? stating that the doctor is no longer in the plan. they don't give you a reason

why. >> with your specialist, you have to find somebody different, too. there is a phone number in here. this letter that i can call. i'm saying, gee, what am i doing? shopping for groceries or what? this is a serious situation here. it's a health problem. >> this is not supposed to happen. they were supposed to be able to keep their coverage, keep their doctor who they have had relationships with for 10, 20 years. and the rug has been pulled out of these people. >> it makes you feel that a lot is not being told. about what it entails and how it will impact your life. >> government doesn't control people. we are human beings. they can run the white house, but they can't tell us what to do. what's in this letter is they are telling you what to do. i resent that. >> to start over again, it doesn't make it -- doesn't make

sense. does not make centimeters. this is not what we want. this is not right that the government is dictating to me what i have to take. >> i thought i would be safe. i thought i would have insurance going forward. now i see it's a different ball game. >> particularly for seniors who need medical care the most. they probably see their doctor more often in a month than most middle-aged or young people do throughout the year. it's not fair to shake up their world in this way. >> you need a doctor who understands who has a heart. they don't care for the old people. they let them go, let them die. we all have to die sometime, we know that. but not when they say it. >> we have a bunch of 85-year-old people who are confused and angry. who's listening? i hope somebody. >> matt bennett, former white

insurers. this wasn't the government taking away doctors. these were people who every year this happens. medicare advantage changes -- >> it changed thanks to obama care because they reduced the payment under medicare advantage. >> well, yes, right. but those payments change all the time. it's just a coincidence that it's happening at the same time as the rollout of the aca. people in the media are conflating these things. >> not just the media. >> wow. >> patients and doctors believe it is related to cuts made to medicare advantage. chris? >> that's an extraordinary fallback position for the democrats, but it is laughable on its face. okay? everybody is getting notices in the mail. like waiting for your draft notice to find out based on your lottery number. i got my letter last week. i self-insure. when obama care passed i was paying $321 a month. now as of last week it's $537 a month for myself.

the woman with whom i live in sin also self-insures. our health insurance payments are now more than the mortgage payments. >> right. >> these guys knew it was programmed to do this all along. >> that's ridiculous. >> it's a scam. >> ridiculous. >> matt, there is a regulation that we are looking at now. internal revenue bulletin that says right here that this is july of 2010 when the administration had this july of 2010 obama care was passed march of 2010 where they specifically estimate that over 70% of the individual insurance market could have their plans cancelled because of obama care. >> there is a good reason for it. first of all, the president was talking about people with insurance on the individual market in march of 2010. these are grandfathered. it's half of the individual market. >> but they are anticipating that the grandfathering won't work, that it will not cover over 70% of those in the market. >> the way the individual market

modeled obama care after massachusetts health care plan. now massachusetts and vermont are talking about getting rid of the national health care system by creating their own single payer systems. at least it's being discussed. joining us now radio talk show host and columnist at the boston herald michael graham with an insider perspective. we have heard it in the massachusetts legislature as now senator jamie eldridge, a democrat, testified that he believes they should implement a universal medicare plan in massachusetts. that's single payer. that's what many people believe obama care would lead to on the federal level. what say you? >> well, it's funny. he's a great guy. he voted for romney care, supports obama care. then you do the math and he says all i wanted was single payer in the first place.

that's what obama care supporters default to. they are watching the system collapse and the math doesn't work. in massachusetts we are the most expensive state in the country. want to be more expensive? be like us. it's 60 to 120 days for your first doctor visit. took me 60 days for my first appointment. it's so bad we have had three tax hikes since romneycare was implemented because the cost of state government health care exploding. 25 cents on the state dollar covered medical for us when romneycare passed. now it's more than 40 cents of every dollar the state collects paid out to romneycare. the system is breaking. >> the argument against it, we discussed it last week with the panel, if this was the plan for single payer and that's you get insurance from the feds.

if this was the deal where we move to single payer how would it work? obama care seems to be collapsing on itself or in danger of that. >> the famous "saturday night live" sketch with christopher walken, more cow bell. this is more government cow bell. no matter how badly they screw it up, more. we have something in massachusetts call add global payment system. they changed the name. they say megyn, we'll give your doctor a certain amount of money. if you go one time, ten times or zero, the doctor gets the money. they are trying to control costs. they can't control it because they keep pouring government money into the system. single payer skip it is middleman, takes it from the your paycheck and gives it to the doctor. >> people believe that's where this is headed. whether the website is a

a texas-sized brawl over a new abortion law in the lone star state. a judge ruled part of the law that was passed is unconstitutional. trace gallagher reports. >> two parts of the law were challenged. one to get admitting privileges to a nearby hospital. that would shut down one-third of all abortion clinics in texas because hospitals are unwilling the to give admitting privileges to doctors who don't admit patients and hospitals with religious affiliations won't allow doctors in the first place. the judge agreed saying the acts admitting privileges is without a rational basis and places obstacles in the path oh of a woman seek ing an abortion of a nonviable fetus. the texas alliance for life says the judge's ruling denies common sense. listen. >> we think that's very

important. in the event of a serious complication after an abortion the physician should be able the to follow that woman to the local hospital where he can continue to treat her. but that's not possible if the physician doesn't have privileges at a local hospital. >> planneded parenthood challenged the requirement that doctors who issue the abortion pill must follow fda guidelines saying they are outdated and dangerous. the judge left the guidelines in place except in extreme cases where doctors would not be legally bound by them. the judge knew this would be appealed. in fact, he said it would go to the supreme court. texas attorney general greg abbott has appealed already to the fifth circuit court in new orleans. democratic texas lawmaker wendy davis gained attention by filibustering the law and is applauding the judge. davis and abbott will likely face off in the next texas

governor race with this being a major issue. >> it already is. thank you. for more we are joined by alexis mcgill johnson from planned parenthood federation of america. the business about whether the doctors need ed admitting privileges at the clinics where the women would have abortions, this is the argument the other side brought. why shouldn't they have admitting privileges? what if something went wrong. wouldn't you want the doctor performing the abortion to have privileges at that time clinic? >> regardless of what happens during the abortion process, and we hope those instances are rare, any hospital will accept a patient. any hospital will accept someone who is in need. it would be against their oath. what the judge did in this case is say it is up constitutional to put these medically unnecessary burdens in front of women when they are having a safe and legal procedure. >> now can you have a facility in texas where none of the

doctors have admitting privileges where abortions are performed? >> yes. that's true. >> doesn't that concern you at all that you could get an abortion -- >> admitting privileges within a certain range. i think the restriction was somewhere upwards of 30 miles around a center. it's not that doctors don't have admitting privileges anywhere near a health center. they are doctors. they have admitting privileges, period. >> i asked you before the segment because the thing weapon di davis was upset about, one of them, was where the line is draup on legal abortions in texas. they made it 20 weeks. there was a debate about whether it should be extended to 26 weeks as was the case. and as is the case in most states of the union. texas made it 20. is that being challenged now? >> it's not being challenged. i think most people, including planned parenthood will be taking on a lot of challenges around the 20-week bans.

breaking tonight, just about an hour ago fox news confirmed that the administration knew as early as 2010 that millions of americans would lose their health care

plans, even as the president explicitly promised the opposite. while the president said the plans would be grandfathered, so if you had a plan you liked when obama care was passed you could keep your plan. we have found an irs bulletin from july of 2010, obama care passed march of 2010 saying, quote, a reasonable range for the percentage of individual policies that would terminate and therefore relinquish their grandfather status is 40% to 67% of those on the individual market. joining me now kristen anderson, vice president of the winston group and uh republican pollster and mark hannah democratic analyst. the president specifically said -- let me tell you what happened. they met. they had a health care summit. john kyl said to him at that summit, mr. president, i'm concerned about the individual market. you're going to require that these policies offer goodies in

that hasn't changed, that your premiums hasn't increased, the terms haven't changed you can keep it. let's put numbers in perspective. >> wait a minute. >> no, no, no. >> hold on. >> let's stay on point. hold on. it's not true. almost a million people have been cancelled so far, mark. the estimates are perhaps as many as 14 million could be cancelled soon. >> what's key -- >> let hark respond and then you can have the floor, kristen. go ahead, mark. >> right. these plans that don't offer the basic protections that the president has been saying all along are required in any insurance plan unless it is grandfathered beforehand, the plans are illegal and the president has been saying that forever. the individual marketplace for insurance is only 5% of the people in this country. >> we are talking about millions of people. >> 3%. >> 14 million people. kristen, i will give you the floor. >> megyn, three times as many --

six times as many of the people don't have insurance whatsoever now. >> mark, he said, period. he said if you like it -- >> they can't keep it. >> i don't see -- >> i gave kristen the floor. go ahead. >> there is something critical in what mark said that opened the door to this if you like your plan you can keep it. if any piece of the plan changed at all then the grandfathering is thrown out the window. >> exactly. >> it's a little tiny loophole that came fromys the law that i allowing the law to get rid of the policies. this whole if you like your plan, you can keep it takes a shot at a republican president. it's the read my lips, no new taxes of this president. this isn't a line he said one time in a speech and may have been an exaggeration.

this was a core piece of the argument for why people should support the law. if you like your plan, you can keep it. the same people who use this individual insurance are entrepreneurs, people who need to insure themselves. >> here is the thing, mark. if he wanted to be honest he shouldn't have said, period. i want the 14 million americans i believe will lose their individual plans the to understand it is a risk. they can call their representative and tell them to vote for obama care or not based on the full disclosure of the information. >> let's wonder why the plans are illegal in the first place. >> no, no. respond to my -- i know you can bridge away to a happy place for you. i get it. that's a skill -- debate skills. >> i heem a happy man right now. >> speak to my point.

let's have a substantive discussion. why did he say "period"? why not "sas trix"? >> for emphasis probably. the guest on before said exactly that. any time there is an incremental change in your plan and you know insurance companies change plans all the time and send you a letter and it's in the fine print. nobody reads it. hhs under kathleen sebelius made it public. reporters had access to the information all along. the fact is those with skimpy benefits and high out of pocket costs so taxpayers have to pay -- >> kristen, it was my fault. it was the media's fault and the american people's fault because they should have understood period didn't mean period. >> they are trying to go into another pint .that it never should have been considered

insurance in the first place. that exposes what it's about. if you go back the to the supreme court argument over whether it was constitutional the debate centered on whether hips was something everybody would need and it was constitutional to mandate it. the question is was health insurance is same as health care? conservatives say it is not. health insurance is something that should protect you against risk. not be the mechanism of payment for every health care service in your life. >> you were grandfathered unless they changed any part of your policy. then guess what. the department of health and human services wrote regulations that sonar rowed what the insurance companies could do that virtually all of the policies had to be changed. that's why millions are being cancelled. kathleen sebelius did it and the president knew it. >> and the insurance companies are cancelling it. >> the president knew it, mark. >> the ceo d -- >> he knew or he negligently didn't know.

republican senator rand paul is introducing the constitutional amendment. he joins us now. good to see you. what's the purpose of this? >> well, ever since i ran for office people would say, you know, what makes me mad is congress passes law and exempts themselves. my amendment would say congress shall pass no law that they exempt themselves or the president or the supreme court. one of the particularly galling things about obama care is the chief justices who decided the case don't have to live under it. they get special health care and don't live under obama care. that's wrong. >> the odds of this passing -- right, because to get a constitutional amendment through you three-fifths of the states, three-fourths of the states. so the odds of getting it through are slim. >> it will take an enormous ground swell. there is a lot of movement for this republican, democrat or independent. there is a great movement for term limits and a lot of d

he said, i am a christian. if you must kill me for being a christian, do it. these were his last words. the president needs to speak out about this. we need to not gloss over that there is a religious component to this. since 9/11 we have been apologizing and saying, oh, this isn't the islamic religion. it's not all of islam. it's a minority, but it is not one in a million. it's about 10%. in england there were 500,000 people who said the subway bombings, i sympathize with killing british citizens in the subway through violence. that's alarming that there is that large of a percentage -- 10 to 15% of islam saying violence against christians and unarmed noncombatants is okay. that's alarming. >> what should our president be doing differently on that? >> speak out about it. we should quit sending money to these countries. we spend over a million dollars to pakistan. there is a woman on death row
